Sample Human Rights Complaint - For Australian Involuntary Treatment Victims & Survivors
KES 350
Categories: Law
Pursuant to international law, intent and purpose are the fault elements for torture, negligence (breach of duty of care) will not suffice, and recklessness will suffice but only in certain circumstances, whereas under Australian federal law knowledge, intention and recklessness are the fault elements and only one fault element need be proved. Whether or not negligence would suffice under state or territory law for involuntary treatment as torture is something the legal profession and law enforcement industries of the nation must commence testing. Not to do so would continue to send the public message to victims and survivors that they’re not equals, and that their rights and freedoms are recognised to a lesser extent than that of others.
The complaint is not political or politically motivated. It’s not directed at a party or an individual on the basis of their membership to a party, but rather is directed at legislative acts aimed at the destruction of human rights that contravene domestic and international law, and give rise to human rights abuses that inflict severe pain and suffering upon individuals and the community as a whole.
